Your Acceptance of this Legally Binding Agreement

BY USING OR ACCESSING THE ELITEHEADSHOTS.COM.AU WEB SITE AND THE INFORMATION, MATERIAL, PRODUCTS OR SERVICES PROVIDED THEREIN BY ELITE HEADSHOTS.  YOU AGREE TO BE LEGALLY BOUND BY THE TERMS AND CONDITIONS OF THIS AGREEMENT.

If you do not agree with the terms and conditions of this Agreement, do not use or access the ELITEHEADSHOTS.COM.AU web site or information, material, products or services provided therein. This Agreement is between you and ELITE HEADSHOTS and is effective at the date of your first use or access of the ELITEHEADSHOTS.COM.AU

You further agree that ELITE HEADSHOTS may change, alter, amend or replace all or any part of this Agreement at any time, that such changes, alterations, amendments or replacements shall be effective as of the time of posting. ELITE HEADSHOTS will provide notice on the ELITEHEADSHOTS.COM.AU web site of any material changes made to this Agreement and your continued use of the web site after the time of posting of such notice will constitute evidence of your acceptance of the changed, altered, amended or replaced Agreement. You further agree to regularly review this Agreement for such changes, alterations, amendments or replacements.

If you do not agree with the changed, altered, amended or replaced Agreement, do not use or access the ELITEHEADSHOTS.COM.AU web site or information, material, products or services provided therein.

ELITE HEADSHOTS may contact you from time to time to notify you of any material changes, alterations, amendments or replacements to all or any part of this Agreement provided that you have given ELITE HEADSHOTS your e-mail address and agreed that ELITE HEADSHOTS may contact you using that e-mail address. We refer you to our privacy policy for further details as to ELITE HEADSHOTS collection, use and disclosure of personal information.

Payment

The session fee is required at the time of booking to secure the session.

Payment can be made by credit card, cash, PAYID, debit card, or bank transfer.
 

Cancellation and Rescheduling

If you need to cancel or reschedule your headshot session, please let us know as soon as possible.

If you cancel or reschedule your session more than 72 hours in advance, your deposit will be refunded in full.

If you cancel or reschedule your session less than 72 hours in advance, your deposit will not be refunded.

If you do not show up for your session, your deposit will not be refunded.

Please note that these provisions are necessary to compensate us for the time and resources that are reserved for your session. We understand that unforeseen circumstances can arise, and we will do our best to work with you to reschedule your session at a more convenient time.
 

RETURN POLICY

If you are not satisfied with the final product, you may request a revision or retouch within 14 days of receiving the final images.

Any revisions or retouches will be completed at no additional charge.

If a revision or retouch is not possible or does not meet your satisfaction, a refund may be issued at the discretion of the photographer.

Copyright and Usage

The copyright of all photographs taken during the session remains with the photographer.

You are granted permission to use the photographs for personal use, such as social media profiles and personal websites.

If you wish to use the photographs for commercial purposes, such as promoting a business or product, you must obtain written permission from the photographer and may be required to pay additional fees.

Model Release

By booking a session with us, you grant us the right to use and publish the photographs taken during the session for promotional purposes, such as marketing materials and on our website.

If you do not wish to grant us this right, please let us know in writing at the time of booking.

Limit of Liability

We take great care to ensure that your photographs are of the highest quality, but we cannot be held responsible for any imperfections in the photographs that are beyond our control, such as poor lighting conditions or technical malfunctions.

In the unlikely event that we are unable to deliver the photographs to you, our liability is limited to the session fee paid by you.

Indemnification

You agree to indemnify and hold Elite Headshots and its affiliates, officers, agents, and employees harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your use of the photographs or your violation of these terms and conditions.

Governing Law

These terms and conditions shall be governed by and construed in accordance with the laws of the State of New South Wales, Australia.
